Users may upload personal photos to create personalized digital artwork. These photos are processed as image files to generate the requested artwork. While a photo may depict individuals or elements that could be classified as sensitive personal information under certain laws, we do not actively process, analyze, or catalog any such characteristics (e.g., we do not identify or store data related to racial or ethnic origin, health information, or biometric data). We do not use facial recognition or create biometric identifiers. By uploading a photo, you warrant you have the legal right to do so, as detailed in Section 8.

Purpose of Use: Core Service Fulfillment — essential for transforming the image into original digital artwork and manufacturing the physical products (e.g., jewelry, accessories) ordered by the User or a gift-giver.

Contact and Identity Data

Name, email address, shipping address, billing address, and telephone number.

Purpose of Use: Order Fulfillment — processing and shipping physical goods. Customer Service — communication regarding orders, artwork previews, and inquiries. Account Management — maintaining a User profile on The Site.

Financial and Transaction Data

Payment information (e.g., credit card numbers, which are typically processed by a third-party processor and not stored by The Company), and complete order history/details.

Purpose of Use: Payment Processing — completing commercial transactions. Legal Compliance — maintaining transactional records for tax and auditing purposes (retention minimums apply).

IP address, browser type, operating system, pages visited, date/time stamps, and device identifiers.

Global Operations Disclosure

The Company is headquartered in the United States. By submitting your data, you consent to this cross-border transfer. Your Personal Information may be transferred to and processed in the United States and other countries. Gift Recipient Handling

If you provide us with information (e.g., name, address) of a gift recipient, we use that information solely to fulfill the gift order. We do not use the gift recipient's information for marketing purposes unless they independently and separately opt-in to receive communications from us.

Clear Opt-Out Mechanisms

All marketing communications will contain a clear, conspicuous, and functional unsubscribe link. We will honor all opt-out requests promptly, which will cease all marketing materials, including messages containing personalized product designs.

Access to Personal Information is restricted on a "need-to-know" basis to only those personnel who require it to fulfill the service (e.g., the digital artist, the manufacturing liaison, customer service).


8. User Warranties and Indemnification for Uploaded Content

By uploading photos to Our Services, you represent and warrant that:

You agree to indemnify, defend, and hold harmless The Company, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your breach of the above representations and warranties. This includes, but is not limited to, any claims brought by individuals whose photos you uploaded without their consent.

When you apply or agree to work with us, we collect information necessary to administer the Program and fulfill legal obligations. This includes your name, email, address, payment details, and Tax Identification Number via a W-9/W-8BEN form.

How We Use & Share Affiliate Information

We use this information to administer the Program, process payments, and comply with tax laws. We share aggregated, non-identifying transaction data (e.g., transaction ID, product, commission) with Affiliates for tracking purposes. We do not share our customers' personally identifiable information with Affiliates.

Tracking & Cookies for Attribution

We use tracking technologies like cookies to attribute sales to the correct Affiliate. This is used solely for calculating commissions. Customers can control cookies through their browser settings.

Updates to Affiliate Privacy Terms

We reserve the right to update these privacy practices specific to the Affiliate Program. Significant changes will be communicated, and your continued participation constitutes acceptance of the updated terms.
